These Terms of Service ("Terms") govern your use of hosting and web services provided by MK-Dizajn ("we", "us", or "our"). By purchasing or using our services, you agree to be bound by these Terms.

1. Service Agreement

By purchasing any of our hosting plans or services, you enter into a binding agreement with MK-Dizajn. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Use our services in compliance with all applicable laws and regulations
• Not use our services for any illegal or unauthorized purpose
• Not violate any laws in your jurisdiction or ours

2. Acceptable Use Policy

You may not use our hosting services for:

• Distributing malware, viruses, or harmful code
• Sending spam or unsolicited bulk email
• Hosting illegal content or engaging in illegal activities
• Cryptocurrency mining or similar resource-intensive activities without authorization
• Activities that compromise the security or stability of our servers
• Hosting content that violates intellectual property rights

Violation of this policy may result in immediate service suspension or termination without refund.

3. Payment Terms & Stripe Security

Payment Processing

All payments for our hosting services are processed securely through Stripe, a PCI DSS Level 1 certified payment processor - the highest level of security certification in the payments industry.

• All hosting plans are billed monthly in advance
• Payments are processed automatically on your billing date
• You can update or change your payment method at any time through your account
• Failed payments may result in service suspension after a grace period
• We accept major credit cards and debit cards through Stripe

Prices and Tax (PDV)

All prices displayed on our website and at checkout are inclusive of 25% Croatian VAT (PDV – Porez na dodanu vrijednost), unless otherwise stated. The amount you pay is the final price.

Business customers in the European Union who provide a valid VAT identification number may be eligible for reverse charge. In that case, the price charged will be exclusive of VAT, and you are responsible for declaring and paying VAT in your own country in accordance with applicable EU rules.

4. Refund Policy

We offer a 30-day money-back guarantee for all new hosting purchases:

• If you're not satisfied within the first 30 days, request a full refund
• Refunds are processed to your original payment method within 5-10 business days
• After 30 days, no refunds are provided for unused service time
• Add-on services and custom work are non-refundable
• Accounts terminated for Terms of Service violations are not eligible for refunds

5. Service Level Agreement

We strive to maintain 99.9% uptime for all hosting services. However, we do not guarantee uninterrupted service due to:

• Scheduled maintenance (notified in advance)
• Emergency maintenance or security updates
• Force majeure events beyond our control
• Issues caused by third-party services

6. Data and Backups

While we provide automatic backups as part of our service:

• Backups are provided as a courtesy and are not guaranteed
• You are responsible for maintaining your own backups
• We are not liable for data loss under any circumstances
• Backup restoration may incur additional fees depending on complexity

7. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount paid for services in the past 12 months
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee that our services will meet your specific requirements
• We are not responsible for content hosted on your account

8. Service Modifications and Termination

We reserve the right to:

• Modify or discontinue services with 30 days notice
• Change pricing with 30 days notice to existing customers
• Suspend or terminate accounts that violate our Terms
• Update these Terms at any time (changes will be posted on our website)

You may cancel your service at any time through your account dashboard. Cancellations take effect at the end of your current billing period.

9. Intellectual Property

You retain all rights to content you upload to our servers. However, you grant us a license to:

• Store, cache, and display your content as necessary to provide the service
• Create backups of your content
• Use anonymized data for service improvement

10. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy. We are committed to protecting your personal information and complying with GDPR and other applicable data protection regulations.

By using Stripe for payment processing, you also agree to Stripe's Terms of Service and Privacy Policy. Stripe's handling of your payment information is governed by their own policies, which can be found at stripe.com/privacy.

11. Governing Law

These Terms are governed by the laws of Croatia. Any disputes will be resolved in the courts of Croatia.
